These Terms and Conditions (“Terms”, “Terms and Conditions”) governs your access and use of the HANTAQ website located at www.hantaq.com (the “Website”, “HANTAQ”, "our", "us", or "we"), as well as the products and services offered and made available through the Hantaq.com. Please read these Terms carefully before you apply for our product and/ or services.

By accessing our website and any of its pages at (https://hantaq.com), you agree to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for complying with applicable local laws. If you do not agree to any of these terms, you are prohibited from using or accessing this website. The materials contained in this site are protected by copyright and trademark law.

Description of service

HANTAQ is a platform where customers post-delivery request or offer job to vendor. We, at hantaq.com is committed to bringing greater automation, transparency and efficiency to delivering documents and cargo by moving it entirely online with an efficient feedback system.

Use of License

a) Permission is granted to download a copy of the material (information or software) temporarily on the Hantaq.com website for temporary and non-commercial viewing only. This is a grant of a license, not a transfer of title, and under this license you shall not:
1. i) modify or copy materials;
2. ii) use the material for commercial purposes, or for public display (commercial or non-commercial);
3. iii) attempt to decompile or redesign any software available on the Hantaq.com website;
4. iv) remove copyright or other proprietary notices from the material; or
5. v) transfer the material to another person or "copy" the material to another server.
b) This license will be terminated automatically if you violate any of these restrictions and may be terminated by Hantaq.com at any time. After discontinuing display of these materials or upon the expiration of this license, you must delete any downloaded information that is in your storage either in electronic or printed format.

User obligations

You warrant that you are either the owner or the authorized representative of the owner of the goods, and that you are authorised to accept and are accepting these Terms and Conditions for yourself or as a representative for and on behalf of the owner of the goods.

You represent and warrant that you shall comply with all applicable laws and regulations relating to the nature, condition, packaging, handling, storage and carriage of the goods and that the goods are not in any manner or condition prohibited by law, dangerous or hazardous or highly perishable.

You warrant that the goods to be delivered by a Driver does not contain or constitute:

i) Hunted animals; part of animals such as ivory, shark fin or other items which are made or processed from animal parts, including other items which are not for human consumption and prohibited items according to international treaties and/or applicable international laws;
ii) Human organs, ashes, bones;
iii) Firearms, ammunition, explosive materials, ignition equipment of all kinds such as gunpowder, etc.;
iv) Illegal items including but not limited to counterfeit or pirated products, illegal drugs or addictive substances, illegal property or any materials which are against the applicable laws, regulations or rules stipulated by federal, state or local government authorities, including the materials which the users have legal right of possession but are not allowed to partially or entirely move or send to other places;
v) Sharp or hazardous objects including but not limited to knives, swords, spears, daggers;
vi) Flammable materials of all kinds such as LPG, NGV, etc.

You represent and warrant that each parcel of goods to be delivered by a Driver shall not weight less than two (2) kilograms in weight per parcel.

Hantaq and/or the Drivers reserve the right to open and check the goods without prior notice to you where Hantaq and/or the Drivers have any reasonable suspicion that the goods may contain or constitute illegal, unlawful or prohibited items as referred to in the abovementioned provisions herein and Hantaq and/or the Drivers reserve the right to refuse the receipt and delivery of such goods.

You shall at all times be responsible for ensuring that you provide Hantaq and/or the Drivers with accurate and sufficient details to enable the Drivers to complete the receipt and delivery of your goods.

Disclaimer

a) The information on Hantaq.com website is provided “as available”, “as is” basis. Hantaq.com does not provide any warranty, express or implied, and hereby disclaims and disclaims all other warranties including, without limitation, implied warranties or conditions of trade, suitability for any purpose, or infringement of intellectual property or other infringement.
b) Further, Hantaq.com does not warrant or make any statement about the accuracy, possible results, or reliability of the use of information on its website or related to those materials or on any third-party websites linked to this website.

Limitations

In any case, Hantaq.com or its suppliers shall not be liable for any damages (including, without limitation, damages due to loss of data or profits, or due to business disruption) arising from the use or inability to use the materials on the Hantaq.com website, even if Hantaq.com or a legal representative of Hantaq.com has been notified orally or in writing of the possible damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or consequential damages, these limitations may not apply to you.

Hantaq and/or its related corporations (where applicable) shall at all times own all the rights, title and interest and to the Sites, Platform, Services, Hantaq’s name, logos, trademarks, service marks, designs, copyrighted materials and all other intellectual property rights of Hantaq.

Applicable Laws

These terms and conditions are governed by and construed in accordance with the laws of Malaysia and you must comply with the exclusive jurisdiction of the courts in that state or location.

Damage Claims

You acknowledge and agree that your access and use of the Platform and procurement of any transportation, logistics and/or delivery services is at your own risk and Hantaq shall not be responsible for any lost, stolen, damaged or destroyed goods. You hereby agree that if you are desirous of insuring your goods, you shall procure your own insurance coverage.

Hantaq shall nevertheless reimburse to you the cost for any lost, stolen, damaged or destroyed goods transported by a Driver subject to a maximum amount of up to RM100.00 (for non-corporate clients) or up to RM400.00 (for corporate clients that have a corporate account with Hantaq) per delivery, subject to the provision of proof of evidence to the satisfaction of Hantaq such as receipts, invoices and photographs of any damaged items.

Assignment

You may not assign or transfer any of your rights, interests or obligations under these Terms and Conditions, wholly or in part, without Hantaq’s prior written approval.

Hantaq may at its sole discretion and as it thinks fit and/or necessary, assign or transfer any of its rights, interests or obligations under the Terms and Conditions, wholly or in part, to:-

a) a subsidiary or an affiliated company;
b) an acquirer of the Company’s equity, business and/or assets; or
c) a successor by means of a merger or acquisition.

Waiver

Any failure or delay by Hantaq in enforcing or exercising any right, power or remedy hereunder shall not be deemed to operate as a waiver by Hantaq to enforce or exercise such right, power or remedy in future or any other right, power or remedy under these Terms and Conditions.

Entire Agreement

These Terms and Conditions constitute the entirety of the agreement and understanding between you and Hantaq with respect to its subject matter and replaces and supersedes all prior or contemporaneous agreements or undertakings regarding such subject matter.

Modifications

Hantaq.com will review the terms of service on this website at any time without notice to you. By using this website, you agree to be bound by the current version of these terms of service. The amended terms are effective from the date they are published on the Carver.my website.
